2. Scope and Types of Data

This Privacy Policy applies to people who visit the Cat’s Atelier website, contact us, use an account, place orders, represent B2B Partners, or receive shipments sent by Cat’s Atelier as part of its dropshipping operations.

Depending on the circumstances, we may process your first and last name, email address, telephone number, delivery address and billing address, company details and information required to issue an invoice, account, order and payment information, the content of correspondence and enquiries, as well as data needed to handle a return, complaint or warranty claim.

We may also process basic technical data, such as your IP address, device type, web browser and information stored in cookies.

3. Purposes and Legal Bases for Processing

We process data for the following purposes:

• operating and securing the website and managing user and Partner accounts;

• accepting and fulfilling orders, including arranging payments and deliveries;

• issuing invoices and keeping required records;

• handling enquiries, returns, complaints and warranty claims;

• ensuring product safety and providing proper after-sales service;

• complying with legal obligations and establishing, pursuing or defending legal claims;

• providing Partners with information relating to cooperation and Cat’s Atelier’s offering, including information about new products, to the extent permitted by law and, where required, after obtaining consent.

Depending on the purpose, processing may be based on:

• Article 6(1)(a) of the General Data Protection Regulation (GDPR) — consent;

• Article 6(1)(b) GDPR — performance of a contract or taking steps prior to entering into a contract;

• Article 6(1)(c) GDPR — compliance with a legal obligation;

• Article 6(1)(f) GDPR — our legitimate interest, in particular operating and securing the website, handling correspondence and protecting against claims.

4. Data of Shipment Recipients in Dropshipping

In the dropshipping model, the Partner remains the seller to its customer, while Cat’s Atelier is the manufacturer and supplier for the Partner.

The Partner may provide Cat’s Atelier with the shipment recipient’s data necessary to fulfil the delivery. The source of this data is the Partner identified in the order.

Cat’s Atelier uses this data exclusively to prepare and deliver the shipment, contact the recipient regarding the order or delivery, handle returns, complaints and warranty claims, ensure product safety and comply with legal obligations.

Cat’s Atelier does not use this data for marketing purposes. The Partner is responsible for lawfully obtaining and providing this data.

The Partner and Cat’s Atelier are, as a rule, separate data controllers in relation to their respective processing activities.

5. Who We May Share Data With

Data may be disclosed to payment service providers, carriers and delivery service providers, providers of hosting, shop software and IT services, providers of accounting, legal or advisory services, and public authorities authorised under applicable law — solely to the extent necessary for the relevant purpose.

With regard to deliveries outside the European Economic Area (EEA), data may be transferred to carriers or other service providers operating outside the EEA. In such cases, we apply the safeguards required by the GDPR.

6. Data Retention and Provision of Data

We retain data for the period necessary to fulfil the purpose for which it was collected, and then for the period required by law or necessary to establish, pursue or defend claims.

Data processed on the basis of consent is retained until consent is withdrawn, unless further retention is based on another legal basis.

Providing data is voluntary. However, data necessary to create an account, fulfil an order, arrange delivery, issue an invoice or handle a request must be provided, because failure to provide it may make it impossible to perform the relevant activity.
